VILLAGE OF CORNWALL-ON-HUDSON LOCAL LAW NO. ________ OF 2021 A LOCAL LAW OFFICIALLY ANNEXING CERTAIN PARCELS OF PROPERTY PREVIOUSLY LOCATED IN THE TOWN OF CORNWALL AND IDENTIFIED ON THE TOWN TAX MAPS AS SECTION 32, BLOCK 1, LOT(S) 8.1 & 8.2
Be it enacted by the Village Board of the Village of Cornwall-on-Hudson, County of Orange, State of New York as follows:
Section 1. Legislative Intent The Village Board of the Village of Cornwall-on-Hudson submitted a petition seeking to annex two (2) parcels of land located in the Town of Cornwall (“Town”), which is designated on the Town tax maps as Section 32, Block 1, Lots 8.1 & 8.2 with an addresses of 45 and 100 Pecks Road, Cornwall, NY (hereinafter the “Territory”). After a joint public hearing between the Town and the Village and after issuance of a Negative Declaration under the State Environmental Quality Review Act (SEQRA) by the Village who was designated Lead Agency, both the Town and Village approved the proposed annexation of Territory from the Town to the Village. The Village of Cornwall-on-Hudson wishes to complete the annexation process of the Territory by the adoption of a local law pursuant to §714 of the General Municipal Law.
Section 2. Findings The Village Board finds that on or about February 8, 2021, the Village Board (as Lead Agency) issued a Negative Declaration pursuant to SEQRA. The Village Board also finds that on or about February 8, 2021 the Village adopted its Resolution, Findings and Order approving the proposed annexation of the Territory into the Village pursuant to General Municipal Law §711. On the same date, the Town of Cornwall separately approved the proposed annexation of the Territory into the Village. The Village Board also finds that for all the reasons set forth in the Village’s Resolution, Findings and Order, as well as the Negative Declaration, that it is in the public interest to annex the Territory.
Section 3. Annexation of Parcel The Village of Cornwall-on-Hudson does hereby annex the Territory as described above. The annexation shall be effective immediately upon the filing of this local law in the office of the Secretary of State. The effective date of the annexation has been determined after giving due regard to the taxable status dates of the Village and Town, as well as the fiscal years of both municipalities.
Section 4. Authority This Local Law is enacted pursuant to General Municipal Law Section 714 (which does not require a public hearing prior to the Village Board adopting this Local Law). Section 5. Rules and Regulations The Village Board is authorized to adopt rules and regulations, by resolution, to further implement the provisions of this Local Law.
Section 6. Separability If any part or provision of this Local Law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances, and the Village Board of the Village of Cornwall-on-Hudson hereby declares that it would have passed this Local Law or the remainder thereof had such invalid application or invalid provision been apparent.
Section 7. Repeal All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed.
Section 8. Effective Date This Local Law shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with section 27 of the Municipal Home Rule Law.
NOTICE OF JOINT PUBLIC HEARING ON PETITION TO ANNEX TERRITORY IN THE TOWN OF CORNWALL TO THE VILLAGE OF CORNWALL-ON-HUDSON PURSUANT TO GENERAL MUNICIPAL LAW ARTICLE 17
NOTICE IS HEREBY GIVEN that a petition (the "Petition") by the Village of Cornwall-on-Hudson (the "Petitioners"), pursuant to General Municipal Law Article 17, has been received by the Town Board of the Town of Cornwall, New York (the "Town") and the Village of Cornwall-on-Hudson, New York (the "Village") for the annexation of the following described territory situated in the Town to the Village consisting of two (2) tax parcels totaling approximately forty ( 40) acres in size: 45 and 100 Pecks Road, Cornwall, New York with a Tax Map designation of Section 32, Block 1, Lot(s) 8.1 & 8.2.
NOTICE IS FURTHER GIVEN that on February 8, 2021, at 7:00 p.m. a joint public hearing on the Petition will be held virtually by the Town and the Village. It shall be deemed to be conducted at the Town of Cornwall Town Hall, 183 Main Street, Cornwall, New York 12518. At such time, all persons interested in the matter shall be heard to consider whether the form of the Petition is satisfactory, whether the proposed annexation is in the overall public interest, and whether there are any issues related to environmental significance under the State Environmental Quality Review Act associated with the proposed annexation. Objections based upon any grounds regarding the form of the Petition [as set forth in General Municipal Law Section 705(l)(a), (b), (c) or (d)] shall, in addition to the presentation of any oral testimony thereon, be submitted in writing on or before the date of the hearing. Copies of the annexation petition with the Environmental Assessment Form will be posted on both municipal websites, or can be requested by contacting the Village Clerk at [email protected] or Town Clerk at [email protected].
PLEASE TAKE FURTHER NOTICE that due to public health and safety concerns related to the COVID-19 Pandemic, this joint public hearing between the Village and Town Board will NOT be conducted in person. In accordance with the Governor's Executive Order 202.1 and subsequent orders extending and modifying the same, the February 8, 2021 joint public hearing will be held remotely via video conferencing and telephone conference call. A transcript will be available at a later date. The public will have the opportunity to hear the meeting live and provide comments at the same time.
