VILLAGE OF CORNWALL-ON-HUDSON
INTRODUCTORY LOCAL LAW NO. __ OF 2021
A LOCAL LAW AMENDING CHAPTER 56 OF THE VILLAGE CODE,
MODIFYING THE COMPOSITION AND TERMS OF THE BOARD OF FIRE COMMISSIONERS OF
THE VILLAGE OF CORNWALL-ON-HUDSON

Section 1. Authority.

This Local Law is enacted pursuant to Article 10 of the Village Law and Article 2 of the Municipal Home Rule Law for the purpose of modifying the composition and terms of the Board of Fire Commissioners for the Village of Cornwall-on-Hudson.

Section 2. Chapter 56- Board of Fire Commissioners.

Section 56-3, entitled; “Members; Compensation; term” shall be deleted and replaced with new section 56-3, with the following text:

Ҥ56-3 Members; compensation; term
A. The Board of Fire Commissioners shall consist of three (3) members, all of whom shall be appointed by the mayor, subject to the approval of the Village Board. The Village Board shall designate a member to act as the chairperson of the Board of Fire Commissioners.
B. The members shall be residents of the Village of Cornwall-on-Hudson and should possess experience in leadership, management, finance, accounting, budgeting, fire and/or rescue services, or such other relevant experience as the Village Board deems appropriate.
C. The members of the Board of Fire Commissioners shall be appointed to three-year terms. The initial terms of office shall be staggered such that one board member’s term shall end on the first Monday of the month following the village general election held after the adoption of this local law, and the second and third board members’ terms of office shall end on the first Monday of the month following the second and third village general elections held after the adoption of this local law, respectively.”


Section 3. Severability.

If any part or provision of this Local Law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this Local Law or the application thereof to other persons or circumstances, and the Village Board of the Village of Cornwall-on-Hudson hereby declares that it would have passed this Local Law or the remainder thereof had such invalid application or invalid provision been apparent.

Section 4. Repeal.

All ordinances, local laws and parts thereof inconsistent with this Local Law are hereby repealed.

Section 5. Authority.

This Local Law is enacted pursuant to the Municipal Home Rule Law. This Local Law shall supersede the provisions of Village Law to the extent it is inconsistent with the same, and to the extent permitted by the New York State Constitution, the Municipal Home Rule Law, or any other applicable statute.

Section 6. Effective Date.

This law shall become effective upon filing with the office of the New York State Secretary of State in accordance with section 27 of the Municipal Home Rule Law.

WHEREAS, the Village Board of the Village of Cornwall-on-Hudson wishes to amend Chapter 56 of the Village Code to restructure the membership and terms of the Board of Fire Commissioners; and
WHEREAS, the Village Board is empowered by the State to adopt such amendment of Chapter 56 pursuant to the Municipal Home Rule Law and the Village Law; and
WHEREAS, the Village Board wishes to schedule a public hearing for July 26, 2021 at 7:00 p. m. to consider the amendment to the Village Code and to consider the potential adverse environmental impacts of the same;
NOW, THEREFORE, IT IS HEREBY
RESOLVED, that the Village Board hereby determines that it will be the lead agency with respect to the review of the proposed procurement law in accordance with the New York State Environmental Quality Review Act (“SEQRA”) and part 617 of the regulations implementing SEQRA, since there are no other agencies that have the authority to approve the project; and let it be further
RESOLVED, that the Village Board preliminarily classifies the aforementioned action as an unlisted action under SEQRA; and
RESOLVED, that a public hearing be held by the Village Board on July 26, 2021 at 7:00 p.m. at the Village Hall located at 325 Hudson Street, Cornwall-on-Hudson, New York, with respect to the proposed amendment to Chapter 56 of the Local Law; and
RESOLVED, that the Village Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.
